1. Introduction

GRUZOVI-CHECK LLC, operating as NoMissCall (“we,” “us,” or “our”) operates NoMissCall. This Privacy Policy explains how we collect, use, and protect information when you use our AI receptionist service at nomisscall.io.

2. Information We Collect

We collect the following types of information:

  • Account Information: Name, email address, business name, and payment information when you register.
  • Call Data: Recordings, transcripts, and metadata (caller number, duration, timestamp) from calls handled by your AI receptionist.
  • Business Configuration: Business hours, FAQ content, appointment settings, and other information you provide to configure your receptionist.
  • Usage Data: Log data, IP addresses, browser type, and pages visited when you use our dashboard.

3. How We Use Information

We use the information we collect to:

  • Provide, operate, and improve the Service
  • Process payments and manage your subscription
  • Send you call summaries and urgent alerts
  • Respond to support requests
  • Comply with legal obligations
  • Detect and prevent fraudulent or abusive activity

4. Call Recording Policy

Our AI receptionist records all calls to provide transcription, summaries, and service functionality. Call recording is a core feature of the Service and cannot be disabled.

Mandatory Disclosure: As an account holder, you are required — not merely recommended — to configure your receptionist greeting to include a call recording disclosure before any substantive conversation begins. The standard disclosure phrase is: “This call may be recorded for quality assurance purposes.”

All-Party Consent Requirements: Several U.S. states require consent from all parties before a call may be recorded, including California (Penal Code §632) and Illinois (720 ILCS 5/14). If your business serves callers in any of these states, you must ensure your disclosure message and consent process comply with applicable law. You are solely responsible for compliance with all such requirements.

5. Information About Callers

When your AI receptionist handles calls on your behalf, it collects data about your callers (“Caller Data”), including:

  • Caller phone number
  • Voice recording of the call
  • Text transcript of the conversation
  • Date and time of the call
  • Any information the caller shares during the conversation

Purpose: Caller Data is processed solely to provide the Service to you — the business using NoMissCall. We do not use Caller Data for our own marketing purposes and do not sell it to third parties.

Legal Basis: We process Caller Data on the basis of the legitimate interests of our account holders (the businesses using NoMissCall) in receiving and managing their incoming calls. Callers are informed of call recording through a mandatory disclosure played at the start of each call, as described in Section 4.

Retention: Caller Data is retained for 90 days from the date of the call. Upon cancellation of the account holder's subscription, Caller Data associated with that account is deleted within 30 days of account closure.

Ownership & Control: Caller Data is owned by you, the account holder. We process it as a data processor acting on your instructions. You are responsible for ensuring your callers are aware that their call is being answered by an AI system and that the call may be recorded. You must comply with all applicable laws regarding the collection and handling of caller information, including TCPA, state call recording laws, and applicable privacy regulations.

Caller Rights & Deletion Requests: If a caller wishes to request deletion of their data, they may contact us directly at admin@nomisscall.io. We will forward the request to the relevant account holder and, where technically feasible, assist in honoring it. As the data controller for Caller Data, the account holder bears primary responsibility for responding to such requests.

6. AI Processing Disclosure

NoMissCall uses artificial intelligence to power its phone answering and receptionist services. This section explains how AI is used in processing your data and your callers' data.

We use the following AI service providers to process call data:

  • Vapi — voice AI platform for call handling and routing (Privacy Policy: vapi.ai/privacy)
  • OpenAI — GPT-4 language model for natural language understanding and response generation (Privacy Policy: openai.com/policies/privacy-policy)
  • ElevenLabs — AI voice synthesis for generating receptionist voice responses (Privacy Policy: elevenlabs.io/privacy)

These providers process call audio and transcript data on our behalf. Each provider is bound by data processing agreements and their own privacy policies linked above.

  • Voice-to-Text Transcription: Call audio is processed by AI speech recognition models to generate text transcripts.
  • Natural Language Understanding: AI models analyze transcript content to understand caller intent, extract key information (e.g., appointment requests, emergencies), and generate appropriate responses.
  • Call Summaries: AI generates plain-language summaries of each call, which are sent to you via the dashboard and optional email/SMS alerts.
  • No AI Training Without Consent: We do not use individual call recordings or transcripts linked to your account for training AI models without your explicit consent. Aggregated, de-identified data may be used to improve our own service quality.

AI-generated responses are designed to be helpful and accurate, but may not always be perfect. We recommend reviewing call summaries and configuring your receptionist settings to reflect your business needs accurately.

7. Data Sharing

We do not sell your personal data or your callers' data. We may share information with trusted third-party service providers who assist us in operating the Service, including:

  • Payment processors (Stripe)
  • Cloud infrastructure providers
  • AI model providers for voice processing
  • Email delivery services

All third-party providers are bound by confidentiality obligations and may only use your data to perform services on our behalf.

8. Data Retention

We retain call recordings and transcripts for 90 days by default. Account data is retained for the duration of your subscription and for up to 30 days after cancellation, after which it is permanently deleted. You may request earlier deletion by contacting us.

9. Security

We use industry-standard security measures including encryption in transit (TLS) and at rest to protect your data. However, no system is completely secure, and we cannot guarantee absolute security.

10. Your Rights

You have the right to:

  • Access the personal data we hold about you
  • Request correction of inaccurate data
  • Request deletion of your data
  • Export your data in a portable format
  • Opt out of non-essential communications

11. California Privacy Rights (CCPA)

If you are a California resident, the California Consumer Privacy Act (CCPA) grants you specific rights regarding your personal information. This section describes those rights and explains how to exercise them.

  • Right to Know: You have the right to request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which we collected it, the business or commercial purpose for collecting it, and the categories of third parties with whom we share it.
  • Right to Delete: You have the right to request deletion of personal information we have collected from you, subject to certain exceptions (e.g., information we are required to retain by law or to complete a transaction).
  • Right to Opt-Out of Sale: We do not sell your personal information to third parties, and we have not done so in the preceding 12 months. You therefore do not need to submit an opt-out request.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. We will not deny you goods or services, charge you different prices, or provide a different level of quality of service because you exercised your rights.

How to Submit a Request: To exercise your Right to Know or Right to Delete, submit a verifiable consumer request by emailing us at admin@nomisscall.io. We will respond within 45 days of receiving a verifiable request. If we require more time, we will inform you of the reason and extension period in writing.

You may designate an authorized agent to make a request on your behalf. We may require written proof of the agent's permission to act on your behalf and may verify your identity directly.

12. Cookies

We use essential cookies to maintain your session and authentication state. We do not use tracking or advertising cookies.

13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of material changes via email. Your continued use of the Service after changes constitutes acceptance of the updated Policy.
