Our AI receptionist records all calls to provide transcription, summaries, and service functionality. Call recording is a core feature of the Service and cannot be disabled.
Mandatory Disclosure: As an account holder, you are required — not merely recommended — to configure your receptionist greeting to include a call recording disclosure before any substantive conversation begins. The standard disclosure phrase is: “This call may be recorded for quality assurance purposes.”
All-Party Consent Requirements: Several U.S. states require consent from all parties before a call may be recorded, including California (Penal Code §632) and Illinois (720 ILCS 5/14). If your business serves callers in any of these states, you must ensure your disclosure message and consent process comply with applicable law. You are solely responsible for compliance with all such requirements.
When your AI receptionist handles calls on your behalf, it collects data about your callers (“Caller Data”), including:
Purpose: Caller Data is processed solely to provide the Service to you — the business using NoMissCall. We do not use Caller Data for our own marketing purposes and do not sell it to third parties.
Legal Basis: We process Caller Data on the basis of the legitimate interests of our account holders (the businesses using NoMissCall) in receiving and managing their incoming calls. Callers are informed of call recording through a mandatory disclosure played at the start of each call, as described in Section 4.
Retention: Caller Data is retained for 90 days from the date of the call. Upon cancellation of the account holder's subscription, Caller Data associated with that account is deleted within 30 days of account closure.
Ownership & Control: Caller Data is owned by you, the account holder. We process it as a data processor acting on your instructions. You are responsible for ensuring your callers are aware that their call is being answered by an AI system and that the call may be recorded. You must comply with all applicable laws regarding the collection and handling of caller information, including TCPA, state call recording laws, and applicable privacy regulations.
Caller Rights & Deletion Requests: If a caller wishes to request deletion of their data, they may contact us directly at admin@nomisscall.io. We will forward the request to the relevant account holder and, where technically feasible, assist in honoring it. As the data controller for Caller Data, the account holder bears primary responsibility for responding to such requests.
NoMissCall uses artificial intelligence to power its phone answering and receptionist services. This section explains how AI is used in processing your data and your callers' data.

We retain call recordings and transcripts for 90 days by default. Account data is retained for the duration of your subscription and for up to 30 days after cancellation, after which it is permanently deleted. You may request earlier deletion by contacting us.
